CLAIMS Claims define the invention and are legally enforceable.
The specification must conclude with a claim particularly pointing
our and distinctly claiming the subject matter which the applicant
regards as his invention or discovery.
COPYRIGHTS Copyrights protect works of authorship, such as writings,
music, and works of art that have been tangibly expressed.
DESIGN PATENT A design patent may be granted to anyone who invents
a new, original, and ornamental design for an article of manufacture.
DISCLOSURE Disclosure in return for a patent , the inventor
gives as consideration a complete revelation or disclosure of
the invention for which protection is sought.
INDEPENDENT CLAIM Is a claim that does not refer back to or
depend on another claim.
INVENTION An invention is any art or process (way of doing or
making), machine, manufacture, design, or composition of matter,
or any new and useful improvement thereof, or any variety of
plant, which is or may be patentable under the patent laws of
the United States.
INVENTOR The inventor is one who contributes to the conception
of a invention, and must be the applicant on the patent application.
MAINTENANCE FEES Are the fees for maintaining in force a patent
based on an application.
PATENT A patent is a property right granted by the United States
to an inventor “to exclude others from making, using,
offering for sale, or selling the invention throughout the United
States or importing the invention into the United States”
for a limited time in exchange for a public disclosure of the
invention when the patent is granted.
PATENT NUMBER Is a unique number assigned to a patent when it
is issued.
PATENT PENDING Is the term that often appears on manufactured
items. It means that someone has applied for a patent on an
invention manufactured item.
PATENTABLE means is an item suitable to be patented and likely
entitled to be patented.
PROVISIONAL PATENT Is an application that allows filing without
a formal patent claim, oath or declaration , or any information
disclosure statement. It provides the means to establish an
early effective filing date and automatically becomes abandoned
after one year by which time a patent application must be filed
to maintain protection.
SERIAL NUMBER A number assigned to a patent application when
it is filed.
SMALL ENTITY Means an independent inventor, a small business
concern or a nonprofit organization eligible for reduced patent
fees.
TRADEMARK A trademark will protect words,
symbols, sounds or colors that distinguish goods and services.
Trademarks, unlike patents, can be renewed forever as long
as they are being used in business.
UTILITY PATENT A utility patent may be granted to anyone who
invents or discovers any new, useful, and non obvious process,
machine, article of manufacture, or composition of matter,
or any new and useful improvement thereof.
